Please take your time to understand these terms ("Agreement") prior to using any of Earthflix's services or browsing our platform. Should you have any queries, contact us at support@earthflix.com.

Earthflix is a media impact platform incorporating the website www.earthflix.com and mobile applications ("Earthflix Platform"). We associate with non-governmental organisations ("NGO Partners"), alongside content providers, producers, distributors, and individuals globally ("Partners") who share our mission to connect impactful storytelling with real-world change.

This Agreement forms a legally enforceable contract between you and Earthflix. By accessing or using the Platform, you agree to be bound by these terms. If you do not agree, you may not use the Platform.

If you reside in the United States, you must be at least 13 years old to use Earthflix. If you reside in the European Union and are under 16, you may only create an account with verifiable parental consent. If you reside in the United Kingdom, South Africa, Australia, Canada, or New Zealand, you must be at least 18, or have verifiable parental or guardian consent.

To access Earthflix Services you will need to create a member account with your name, email address, and personal password. You may not select a name you do not have the right to use, or impersonate another person. Your account is non-transferable.

You agree to provide accurate, complete, and up-to-date information and to keep your password confidential. You are responsible for all activity under your account and agree to notify us immediately at support@earthflix.com if you suspect unauthorised use.

You may deactivate your account at any time through your account settings or by contacting support@earthflix.com or dpo@earthflix.com. Deactivation does not remove Earthflix's ability to claim any outstanding debts that are due and payable.

Earthflix retains all rights, ownership, and interest in the Platform. We offer you a non-exclusive, non-transferable, non-sublicensable limited licence to use the Platform for personal and non-commercial purposes only.

This licence does not permit you to use the Platform for commercial business operations, nor does it allow you to reproduce, modify, or exploit the Platform or any content provided on it.

Your experience may differ across devices and could be influenced by factors such as your location, available bandwidth, and internet connection speed. You are responsible for all internet access fees associated with your use of the Platform.

All intellectual property rights in the Earthflix Platform are either our property or have been licensed to us by third parties. The Earthflix name, logo, and all page headers, custom graphics, button icons, and scripts are trademarks of Earthflix or our partners and licensors and may not be copied, imitated, or used without prior written permission.

Filmmakers retain ownership of the content they upload. By submitting content, you grant Earthflix a worldwide, non-exclusive, royalty-free licence to host, stream, distribute, and promote your content on the Platform and associated marketing channels.

You may not upload content that infringes on the intellectual property rights of others, contains illegal material, promotes violence or hate, or is misleading about its impact claims. Greenwashing is taken seriously and may result in immediate account termination.

Earthflix does not accept unsolicited materials or ideas for content, and is not responsible for any similarity of its content to materials transmitted to us.

You agree not to: transfer, copy, or display any content except as permitted in this Agreement; sell, rent, lease, or distribute any rights to the Platform; harvest email addresses or personal information by electronic or other means; remove proprietary notices from the Platform; or attempt to disable, bypass, or circumvent any content protection system.

You may not attempt unauthorised access to, interfere with, or damage any parts of the Platform, its servers, or any connected systems. You may not introduce viruses, Trojan horses, worms, logic bombs, or other malicious material.

You may not use automated tools (bots, scrapers, crawlers) to access the Platform without our written permission. You may not employ technology to conceal or disguise your geographic location to circumvent content restrictions.

You may not use the Platform or its services for any commercial or illegal purposes.

Earthflix connects viewer engagement to real-world impact through verified partnerships with NGOs and impact organisations. Impact metrics (trees planted, CO₂ offset, ocean plastic removed) are calculated based on data provided by our impact partners.

While we work with verified partners and strive for accuracy, impact figures are estimates based on the best available data. Actual outcomes may vary due to factors beyond our control.

Impact credits earned through viewing are attributed to projects as described on the Platform. Credits do not have monetary value and cannot be exchanged, transferred, or redeemed for cash.

Platform access is provided at no cost. To facilitate revenue generation, Earthflix operates a commercial model inclusive of brand sponsorship.

Earthflix may offer paid subscription tiers in the future. The features, pricing, and terms of each tier will be clearly presented before you subscribe. Paid subscriptions would be billed on a recurring basis unless cancelled before the next billing cycle.

We reserve the right to change pricing with reasonable notice. Existing subscribers will be notified at least 30 days before any price change takes effect. In the appropriate circumstances, refunds will be provided by Earthflix.

To the fullest extent permitted by applicable law, Earthflix and its subsidiaries, affiliates, officers, employees, agents, partners, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages resulting from your use or inability to use the Platform.

Earthflix's liability to you for any cause whatsoever will at all times be limited to the amount paid, if any, by you to Earthflix during the term of your membership.

You agree to indemnify and hold Earthflix harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of content you submit, your use of the Platform, or your violation of these Terms or any rights of another.

While Earthflix Services are rendered with a reasonable level of proficiency and care, the Platform and all content are provided "as is." Earthflix does not warrant that the Platform will be uninterrupted, error-free, or free from harmful components. In certain jurisdictions, laws may imply warranties that cannot be excluded — these Terms should be read in compliance with those statutory provisions.

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of Earthflix shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Before filing a claim, you agree to try to resolve any dispute informally by contacting legal@earthflix.com. If a dispute is not resolved within 15 days, either party may bring a formal proceeding.

You may only resolve disputes with Earthflix on an individual basis and may not bring a claim as a plaintiff or class member in a class, consolidated, or representative action.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

We may terminate your account, delete your profile and any content you have posted, and prohibit you from using the Platform for any reason, at any time, with or without notice, including if we believe you are in breach of these Terms or are under the applicable minimum age.

Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive (including intellectual property, liability limitation, and indemnity) will continue to apply.

This Agreement will continue to apply as long as you are a registered member, and your obligations under this Agreement survive for as long as permitted by law.

Earthflix may modify these Terms from time to time. When we make material changes, we will notify you by email or through a prominent notice on the Platform. Your continued use after changes are posted constitutes your acceptance.

If you do not agree to any changes, please discontinue use of the Platform.
